problem with RMA of Ballistix ram

so i had some ballistix ram that were dead since day 1, i finally got around to sending them into crucial for RMA. i chatted with a customer support agent who told me they dont have my part in stock and there is nothing they can do to help me. and i will just have to wait until they get more, and they dont have a ETA date.

 

you guys have any tips some helpful hints on what i can do about this?

try to negotiate having it replaced with something they do have in stock. chances are they aren't going to mind sending you a slightly better product so they can close the case quicker.
